The Harborne Event Consultancy Ltd and its affiliates (collectively "THE Consultancy") makes available information, materials, products (including software), and services on THE Consultancy's Web site located at www.theeventconsultancy.com (the "the Site"), is subject to the following terms and conditions. These Terms of Use ("Terms of Use") apply to the Site, as well as any features or content we may add in the future. By accessing or otherwise using the Site, you agree to the terms and conditions as outlined in this legal notice.

Use of the Site
You may download, view, copy and print documents and graphics incorporated in the Site (the "Documents") from the Site subject to the following:

THE Consultancy reserves the right to revoke access and use of the Site and any such use shall be discontinued immediately upon notice from THE Consultancy.
Any use of software and accompanying documentation you download from the Site, if any, is subject to the terms of a software license agreement between you and THE Consultancy. You must read the license agreement and indicate your agreement to its terms prior to installing or using the software. All rights, title and interest not expressly granted are reserved.

User ID's and Passwords

A password and User ID are private information. Any use of a User ID (the unique identifier associated with the person and assigned by THE Consultancy) is the responsibility of the individual to whom the User ID is assigned. Any use of files associated with a User ID is also the responsibility of the individual to whom the User ID is assigned. THE Consultancy will not be liable for any loss or damage cause by unauthorised or shared use of a User ID and/or password.
Each individual is responsible for safeguarding passwords for their User ID.
Passwords must not be shared. It is against policy and, in most cases, the law to use another individual's account or file. Failure to conform to these restrictions may lead to the suspension of the User ID or other action as deemed appropriate by THE Consultancy.

Warranties, Disclaimers and Limitation of Liability

To the fullest extent permitted by law and except as expressly provided for in these Terms of Use or otherwise in an agreement between you and THE Consultancy, all software, services, Documents, third-party links and information on the site are provided "as is" without any other warranties or conditions, express or implied and THE Consultancy shall have no other obligations, duties or liabilities whatsoever in contract, tort, statutory duty or otherwise to you. If you wish to rely on any information contained on this Site, you are strongly advised to seek further verification specific to your requirements from an appropriate source.
So far as is permitted by law THE Consultancy makes no warranty to you as to the quality of the software, services, Documents, third-party links and information on the site or their fitness for any particular purpose.

THE Consultancy shall not have any liability to your for loss of revenue, business, anticipated savings or profits or any loss of use or value of any equipment or loss of reputation or goodwill or for any indirect or consequential loss howsoever arising.

Nothing in these Terms of Use:-
(a) exclude or restrict THE Consultancy for liability in respect of the death or personal injury or fraud resulting from THE Consultancy’s negligence, its employees or agents;
(b) exclude the conditions and warranties implied by Section 12 of the Sale of Goods Act 1979 and where you deal as a consumer, the conditions implied by sections 13 to 15 inclusive of the said Act and by sections 3 and 4 of the Supply of Goods and Services Act 1982; or
(c) where you deal as a consumer, affect your statutory rights.
THE Consultancy disclaims all liabilities in connection with the following:
·      loss of material uploaded
·      incompatibility of the Site with any of your equipment, software or telecommunications links
·      technical problems including errors or interruptions of the Site
·      unsuitability, unreliability or inaccuracy of the Site
·      viruses, against which you are expected to take all appropriate safeguards
Nothing in these Terms of Use shall prevent THE Consultancy from pursuing payment of a debt against the Customer.
Where you access this Site from locations outside the United Kingdom, you do so on your own the initiative and you are responsible for compliance with local laws.
The Site can be accessed from other countries around the world and may contain references to THE Consultancy products, services and programs that have not been announced in your country. These references do not imply that THE Consultancy intends to announce such products, services or programs in your country.

Indemnification

As a condition of access to this Site, you agree to indemnify and THE Consultancy its agents, employees and licensors for all losses, costs, fees (including legal fees) and expenses or liabilities and including third party claims, arising from any breach by you of these Terms of Use or any rules and regulations of competent authority relating to the appropriate use of the internet and information technology equipment or breach by you of any contract between you and THE Consultancy and against any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with your use of the Site, including but not limited to infringement of any copyright or violation of any proprietary or privacy right.
